Your Rights, Your Information

Data Protection

The Data Protection Act 1998 sets out the requirements for the protection of information relating to individuals and people's rights in relation to how their personal information is used.

NHS North Yorkshire and York takes its duties under the Data Protection Act seriously, and has implemented a number of processes and procedures to ensure compliance. Some of these are listed below:

NHS North Yorkshire and York Privacy Notice

This information was produced in order to inform our patients how patient data is processed.  It explains:

  • our commitment to confidentiality

  • what data are collected

  • who it is collected from

  • why it is collected

  • how data is processed

  • who can access it

  • what procedures govern data handling

NHS North Yorkshire and York must keep your personal health information confidential. It is your right. These pages, and the accompanying leaflet and booklet, explain how we do this.

A booklet, leaflet and a poster are available for distribution to all NHS North Yorkshire and York locations to inform our patients and service users about how we use their information, or these can be downloaded here:

To comply with the law, NHS North Yorkshire and York has registered with the Information Commissioner's office. Our register entry can be viewed at the Information Commissioner website. Select register of data controllers from the quick links and search the register using 'North Yorkshire and York Primary Care Trust’ in the 'Name' field.

Access to Your Personal Information

The Data Protection Act gives you the right to view any records held about you, subject to certain exemptions. This right extends to your health records.

If you wish to see a copy of your health records you must contact the Records Manager, contact details below. You may be asked to fill in a form giving details of yourself and what records you require. You may also be charged for copies of your records. A copy of the request for access form and the fees we may charge are available here:

Members of staff are also entitled to ask for a copy of their personnel records and should contact their line manager, or the HR department to discuss this.

NHS Care Record Guarantee 

The National Health Service in England aims to provide you with the highest quality of healthcare. To do this, we must keep records about you, your health and the care we have provided to you or plan to provide to you. NHS health records may be held on computer, on paper or a mixture of both. The NHS Care Record Guarantee provides information about: how your information is managed.

This guarantee is our commitment that we will use records about you in ways that respect your rights and promote your health and wellbeing.

Caldicott Guardian

The Caldicott Guardian has been appointed by NHS North Yorkshire and York to protect the confidentiality of information about individuals including users of services. The Caldicott Guardian is responsible for advising on, agreeing and reviewing protocols governing the protection, use and disclosure of information about individuals that may be identifiable. Data Protection Advisor

NHS North Yorkshire and York has an Information Governance Manager who is responsible for advising on and monitoring data protection practice on how we use personal information across the organisation. National Initiatives we must take part in

National Patient Safety Agency

The NHS North Yorkshire and York, works in partnership with the National Patient Safety Agency (NPSA) by reporting patient safety incidents to the NPSA through the national Reporting and Learning System (RLS). Information is passed to the NPSA to enable it to learn from patient safety incidents and perform its functions relating to the ongoing management of health care services in England and Wales. National Fraud Initiative

Together with other public sector organisations, we are required to participate in the National Fraud Initiative. As part of this, we provide staff payroll information for data matching. Data matching involves comparing sets of data, such as the payroll or benefits records of a body, against other records held by the same or another body. This document provides further information:
